From Scotland to Seattle, stories saturated the mainstream media last weekend with the headline, “Police: Knox did cartwheels after murder.”
The reports were referring to Italian police investigators who stated in court that Amanda Knox “acted inappropriately” while performing some curious calisthenics just four days following the murder of her British roommate, Meredith Kercher.
Knox, of West Seattle, is on trial with her boyfriend, Raffaele Sollecito, for the group murder of Kercher in Perugia, Italy, where Knox attended college on a University of Washington foreign exchange program, and where, on the night of Nov. 1, 2007, the murder took place.
A third suspect, Rudy Hermann Guede, has already been convicted of the murder and is serving time.
The prosecution claims the three converged in a deadly sex ritual and killed Kercher. Reports say that on Nov. 5 Knox performed cartwheels, consistent with what they claim as Knox’s "strange behavior" she exhibited on other occasions shortly after the murder. But according to Chris Mellas, Amanda Knox’s stepfather, what began as an exaggeration from the prosecution quickly became a myth in the press.
“Amanda accompanied Raffaele to the station where he was then interrogated by Monica Napoleani, the Perugia chief of homicide. Amanda was there to support him, as he had supported her before, when she was interrogated,” said Chris Mellas. Chris Mellas is the husband of Edda Mellas, Amanda’s mother. Both live in West Seattle.
“She was actually sitting alone in a separate room waiting for her boyfriend, and Napoleani said in court Friday (Feb. 27) that when she went to get some water she walked by the room where Amanda was and saw Amanda ‘doing the splits.’ She said she thought this was ‘odd behavior,’ and that Amanda should have instead appeared to be mourning the loss of Meredith. The tabloid press further sensationalized her statement by changing ‘the splits’ to ‘cartwheels,’ and the mainstream press ran with that. ”
“Amanda does yoga to calm herself down and relieve stress, and she told her father and me that’s why she was doing the splits. Also, in those four days she was in mourning over Meredith, which followed her outrage. Six hours after the discovery (of the body) she was like, ‘Let’s find the bastard who killed her.’”
Chris Mellas will fly to Italy this week to attend the trial and to support his stepdaughter. He will relieve her father, Curt, who has been there for several weeks. Family members rotate so that at least one relative is with Knox during the trial.
In Italy trials like these are held only on Fridays and Saturdays to allow jurors to work during the week, and to spend nights at home.

Regardless of Amanda Knox's need to perform yoga in order to relieve stress, her behavior certainly raises questions about her moral compass. It would be difficult to imagine that any caring or concerned individual (particularly a roommate) would behave with such cavalier disregard following the butchery of a friend! In defending their daughter's behavior, I am beginning to wonder whether the parents should visit a psychiatrist, too! Shame on all of them!

alleged mis-reporting
Andrea Vogt is covering this trial for the PI. She is a well-respected reporter, based in Italy and fluent in Italian. In the report she filed after last weekend's sessions, she stated that the testimony given by police officers was that Knox was indeed doing splits and cartwheels. She is not the only qualified reporter to have provided this information and, unlike Shay or Mellas, was actually in the courtroom when the testimony was given.
The WS Herald reporter owes it to readers to do a little more digging rather than merely sitting passively while friends and family spin and then just repeating whatever is said. He does a disservice to readers.

Miscommunication problems
This entire case has become such a hornet's nest of cross-cultural misunderstandings, miscommunications, bad translations and tabloid exaggerations that it is difficult to know who or what to believe. Nobody gets anything straight and misinformation is repeated in every report.
A young woman is dead, murdered, and it seems pretty clear the investigation is incomplete at best. This public rush to judgement serves no purpose except to confuse things even more. Even worse, it's disrespectful to her memory and her family must be mortified.
The search for the truth is not about winning or losing a court battle, it's not a contest about who is right or wrong in the search, but about justice for the dead and closure for the living. Putting innocent people in jail is not going to bring Ms Kercher back and it's not going to stop this from happening again if other perpetrators are still out there.
Some solid professionalism is called for here - in the investigation, on the part of the police and in the reporting by the press and from the court hearing the evidence. This isn't a reality TV game put on for entertainment - it's real life.

Response: No one has suggested that Amanda Knox should have been crying in the police station while she waited for the completion of her boyfriend's interrogation. How about this for a reason to display some measure of decorum: You are in a grave situation; the murder of your roommate has occurred a mere FOUR DAYS AGO!! The point isn't whether or not Knox's yoga stretching in the police station was OK or not. No one's claiming that it's a crime to do yoga in "inappropriate" places, or even to be insensitive or idiosyncratic.
The problem here is that she's being tried on the Internet, which is just not right. It's a kind of lynch-mob phenomenon, which the Web makes temptingly easy to join in. What we should all try to do is withhold judgment and wait for the trial to do its work. But it's hard to wait because people feel outraged; this was a terrible murder. It's also not right for anyone--including her supporters--to make misleading or false statements about the evidence. It's one thing to love a friend or family member unconditionally, it's another to ask others to turn a blind eye to serious evidence, or to mislead people about it.
To my mind, the most damaging (to the defense) evidence is that there was a clean-up and staging after the murder, including a crude attempt to fake the appearance of a break-in. As I understand it, this is basically why Knox and Sollecito are on trial--because there was definitely a cleanup, and definite signs of more than one assailant, and these facts all by themselves strongly implicate Knox (who else would have a reason, and the opportunity, to clean up the place and stage the crime scene)? This plus the other evidence, from DNA and blood to circumstantial evidence like behavior, adds up to look very bad for her in a way that's hard to explain away even if there has been impropriety or incompetence in the investigation (as the defense alleges).
However, none of us knows what happened, we're all just worried bystanders without access to all the facts, so keep in mind that no matter how bad it looks, it's possible we're mistaken.

So Steve, are you stating here that Andrea Vogt, reporting from Italy for the PI and in the courtroom for the entire proceedings, is wrong when she reports that a police officer testified Knox was doing the splits, backbends and cartwheels (perhaps an asana cartwheel)? I understand that it would be unethical for you as a professional journalist you to compromise a source, but could you please clarify what you mean? Are you saying here that according to your source the Italian and English-speaking reporters all got their information wrong?
Does your source also confirm that, according to police, Knox was not beaten or tortured as has been widely claimed over the past year?
Finally, I'm curious about the questioning that led to the false accusation against Patrick Lumumba. I have read in the Italian and English-speaking press that the questioning started at 11 pm, which means that earlier claims of a 14-hour interrogation session without food or water are false. Could you ask your source about this as well?

As a reminder, she was also in the courtroom and is bilingual. But if she got the other information wrong, according to your source, then it is best to check. Wow. I suppose if someone you knew for about 3 weeks died you would be unable to eat, sleep and would sit unmoving for months. Your moral compas must be PERFECT! Imagine a girl whose roomate was killed going with her boyfriend of less than 2 weeks to support him while he spoke to the police regarding how he could be of assistance. She did not have to go with him but she was trying to help as well. She sat and waited ina room for hours while Raf spoke to the police. She srtetched her back and legs a bit. Seriously, why are people so personally invested in this case? It makes no sense. Unless you actually know the victim or the accused, seriously, get a life. The most interesting part
The most interesting part was hearing that the trial is on Fri/Sat in order to allow the jurors the work during the week. Sounds a good idea. People try to get out of jury duty as the pay is only $10. If they were allowed to keep working, I'll bet more people would participate.

Naive, inappropriate or immature but not consistent with someone who participated in a violent murder of a roommate. None of the personality traits the embellishing British press has referred to fit the profile of a murderer or rapist. The tabloid sensationalism has distorted so many facts that the public is forced to be skeptical of the prosecution (at least if you are of balanced mind).
Regardless, the trial has brought forth only two pieces of evidence that are worth considering; the footprint and the glass from the broken window atop displaced furniture.
All character studies in a psychological analysis would favor the defendant, obviously to the dismay of the tabloids.

The trial is in its very early stages and is scheduled to run for many months. I don't believe we have seen all or even a significiant amout of the forensic or circumtantial evidence yet.
It will be interesting to see what emerges as the trial advances.

Luckily, most people don't read the tabloids for information. I'm not sure what character studies you are referring to or what they have to do with the case at hand, however. One of the basic tenets of psychological analysis, though, is that it has limited predictive value. Again, the only analysis that is of value now involves the body of evidence, as presented by the prosecution, and the rebuttals put forth by the various defense teams.
But it is important to be realistic: both Knox and Sollecito face an uphill task in terms of convincing the judge and the jury of their credibility. Both have lied and changed their stories more than once. Knox accused an innocent man of the murder. The testimony that emerged last weekend pretty much lays to rest the idea that she was coerced or subject to anything remotely approaching 14 hours of non-stop interrogation.
Personally, I think both Knox and her supporters would have more credibility if they set aside these obvious misstatements.
The statement made by Chris Mellas in this article is a good example of such misstatements. He claims that the tabloids once again misrepresented the facts. But this is simply not true. Every major paper with a reporter in the courtroom reported that Knox was said to have been doing "cartwheels" and the "splits" because that is what the two officers said on the witness stand. Maybe they were wrong, technically speaking, because Knox was in fact doing a yoga move that resembles a cartwheel to the uninitiated. But the reporters were not wrong to state that this is what was said in the courtroom, and the non-tabloid press was not wrong to carry this information. It neither originated in the tabloids nor was it limited to the tabloids.

Inaccurate, biased, sycophantic reporting/spin
For you to report Knox' on stepfather's spin and and overtly biased and inaccurate interpretation of the testimony is, while ultimately useless to an evaluation of what occurred in the course of her interviews with the police, may be marginally understandable. What is NOT acceptable is for you to treat his statements (or the reliance on unspecified "sources" in the courtroom) as FACT as opposed to what it is--more spin from Knox supporters. Had you closed the report with the following line, it would have at least been loosely definable as journalism:

Nobody has proven this nor have valid statements of such been presented in court yet. The only thing presented to date are summaries of what Knox alledgedly said. Nobody to date have seen signed confessions or any other material signed by amanda that has proven that she accused an innocent man of murder.
Steve, as you know, there is a trial going on right now at it is this trial that a jury (and a few judges) will decide if Amanda actually accused an innocent man of murder.....so, unless the person has already been given a judgement in the case, I would have to say that the above remark about Amanda is not legal!

Whatever you wish to call it, the statement you cite is clearly not libelous. As I understand it, officers testified last weekend that Amanda Knox accused Patrick Lumumba of murdering her flatmate, Meredith Kercher. Lumumba was later released for lack of forensic evidence and because 26 witnesses came forward to support his claim that he was at his bar working on the night in question. So the accusation is indeed a false one. Knox's own lawyers have stated for the record that their client falsely accused Lumumba and warned her of the serious consequences.
Lumumba is seeking damages from the Italian state (as is his right under Italian and EU law), and in a separate matter is suing Knox for "calumny". There is no doubt at this stage that he is an innocent man, and Knox's admissible written statement, plus the testimony of the officers who questioned her, support the opinion that Knox indeed accused an innocent man. Indeed, Lumumba's bar was closed for several months and, once it reopened, went out of business.
Having followed this case for nearly a year, and having read the body of opinion expressed on the Internet with regard to this matter, I would say that this hardly qualifies as a libelous statement.
Moreover, it would be nearly impossible to establish a plausible monetary value for the prejudice allegedly accruing from this statement.
If you as a reader feel the post should be removed because it offends you for some reason, then your best bet would be to flag it as abusive, explain why it is so, and ask that it be removed. I would imagine the paper would comply immediately.
Libel Laywer almost right
The only difference is that you have assumed that the police testified truthfully and that this statement you refer to is actually her statement and signed by her.
As stated many times, these statements have been referred to but never presented in their pure true form with her signature or any recorded proof of such. The only thing referred to is the summarized statement provided by the prosecutor as to what was said that night. 14 hours and a single page statement? Come on now lets be honest about the lack of information about these key hours. Imagine the local girl who was violated by the deputy recently as she was being put in the holding cell. Without the video of the overuse of force, the deputy and the rest of the force there would have denied the girls claim. People always believe the police over the "criminal".
The italians have not provided anything from that 9 to 14 hour period other than statements by thte police addressing a so called "confession".
So at this point, there is no proof that has been accepted as fact to the claim that Amanda said Patrick murdered anybody. You have heard only reports from the press. What you say means that I could hear from a news report that someone heard a cop testify that libel lawyer sexually assaulted my niece. Now I go out online and call you a perp and everything that goes along with that. I would bet you would want to sue me for that!
NOBODY, unless you are sitting in the courtroom with an interpreter and you spend the entire time in the courtroom and have full knowledge of all proceedings and casefiles (complete not cherry picked) then you know nothing about this case other than what you have seen printed.
There are only a couple of media reps from the states that are in Perugia but again, they like others are more interested in selling papers. They are not interested in the truth or the injustice that has taken place. They too cherry pick pieces of information and the rest of you buy into that crap.
Mr libel lawyer, since you are on the legal side of things. Can you tell me what a cartwheel has to do with the murder of Meredith? Can you tell me how people should act at a police station? How many days should they cry? Are they allowed to be in shock or should they cry day after day after day. Amanda had known for 6 hours prior to the girls at the station about Merediths death. Should she go through the initial knowledge phase a second time?
All many of us want is the truth about the 14 hours in the police station. All they need to do is produce audio and/or video of the full interrogation(s). Look, they have time to set up bugs in rooms to record Amanda and Raf and Amanda and her mother...etc.... Are you to make us believe that with a woman in police custody they should not be recording? They have a foreign citizen in their jail, don't they want to record everything to prevent what is happening now?
So the police continue to hide the truth about that time and until they provide the information (not the PM summary) than I do not believe the police.
"inappropriate" behavior
Her behavior at her own trial may be considered "inappropriate" as she always appears buoyant and optimistic, even when facing potentially dire consequences. This demonstrates she is given to "inappropriate" behavior and "inappropriate" behavior is a unique and consistent characteristic of hers. Most people, guilty or not, would reflect the gravity of their potential fate, in a solemn and grim demeanor. Just because she appears happy at her trial, we should not conclude she is apathetic about her fate. If anything, her demeanor is an indication of naivete and immaturity - certainly not guilt.
Stop Spinning
Her own LAWYERS have admitted that she accused Lumumba. How ridiculous for anyone to try and claim that this never happened. The JUDGE has ruled that the written 'dream' confession is admissable.
I usually find that in any case where EVERYONE has to be either mistaken or lying and EVERY piece of evidence has to have been mishandled or misinterpreted in order for the defendant to be innocent, that the defendant is almost certainly guilty.
This holds true for Amanda Knox. The circumstantial evidence, physical evidence, series of lies and confessions and retractions and multiple instances of extremely inappropriate behavior all paint a picture of her guilt.

Ergo, one could reasonably interpret Amanda's cartwheel(s) as a manifestation of the joy/ energy burst that followed her 'taking' of poor Meredith's life/ dignity (a form of 'pay-back' for Meredith having called Amanda a "drugged up little tart").

As a psychiatrist I would remind that there is very little differences in behaviour in the Western world. To turn cartwheels and behave childishly when your flatmate has just been brutally murdered in Italy is as odd and as it would be in the US.
It would not be ususual at all to interpret this as euphoria.
And it would certainly not be unusual for watchers to think that she should have a little more respect, humility and at least make an effort whist in a police station.
However, there are many other pieces in this case which are not behavioural but also evidential.
Footprints, DNA samples, timelines, verbal evidence all point to the present accused.
We will just have to wait for the second part of this trial, now to begin, to see how each piece of evidence is explained.
The Italian legal system may be a little different to our own but as a person who lived in Europe for over 12 years, I would say that it is certainly fair, not third world and the truth will out.

Nonsense. What better time is there to put to use a skill and practice expressly designed for the purpose of improving focus, meditation, thoughtfulness, and compassion, then such a tragedy as this? Yoga is a very old religious practice in parts of the world; these acts were no more cavalier than a Christian praying. Many posts here indicate American cultural-centricity is alive and well...

If you think Amanda Knox is guilty, then why? Because you heard someone say so? Because you accepted without questioning some myth about a cartwheel or accusing an innocent man? (Not true.) If the information you heard is wrong, then so is your conclusion. If she was your daughter/sister/friend, wouldn’t you want people to listen to both sides of the story before deciding?
